Mr K was charged with the offence of rape after a significant, lengthy investigation into non-recent child exploitation in the West Yorkshire area.
Mr K, with several other Defendants, stood trial at Bradford Crown Court, which lasted more than six weeks. The allegations against Mr K were that he had raped the complainant many years ago.
The complainant gave a video gave a video recorded interview to the police, which was then played before the jury, together with her cross-examination. This is the norm for cases like this.
Mr K gave evidence and accepted that he knew the complainant, but that she had fabricated the allegations, and no sexual activity of any sort ever took place.
After deliberating for days, the jury returned with a unanimous verdict of Not Guilty for our client.
Barrister, Ms Erimnaz Mushtaq, was instructed by Whiterose Blackmans Solicitors. Ms Mushtaq is extremely experienced in such cases. Ms Mushtaq and the team at Whiterose Blackmans Solicitors have an amenable acquittal rate.
One of the key factors in this case was the statement Mr K had provided to the police at the investigation stage, which Whiterose Blackmans Solicitors had advised him on.
In all cases, it is extremely important that early legal advice is taken to ensure that a defence is raised at the earliest opportunity, avoiding adverse inferences at trial.
