Mr S was charged with the offence of rape. He was a taxi driver, and the complainant was a customer.
It was alleged that Mr S had picked up the customer, and during the journey, he stopped the vehicle and forced himself onto her. The complainant stated that she could not recall exactly what happened, but she was aware that the driver had stopped the taxi and was on top, having sexual intercourse with her. She did not consent to this.
The complainant undertook a video recorded interview to the police, which was then played before the jury, together with her cross examination. This is the norm for cases like this.
Mr S accepted that he had sexual intercourse with the complainant but maintained that it was the complainant that initiated sexual contact and all sexual activity was consensual.
The defence put forward a rigorous argument depicting some messages served as evidence. This included thorough preparation of all material served and putting forward additional documents that aided the defence case.
Mr S was unanimously acquitted of rape.
