Legal Advice for Unmarried Couples

If you are in a relationship with your partner and are not married, you may be surprised to learn that there is no such thing as a “common law” husband or wife. The term ‘cohabitation’ refers to couples who live together without marrying or entering into a civil partnership.

As a cohabiting couple you have limited and different legal rights and responsibilities in relation to property, finances and children than a married couple.

No matter how long you have been living together, this does not give either party any automatic rights over the other or the property.

You may have cohabited with someone for 25 years or more, but you may still have less rights than a person who has been married for 5 years or less.

Wills for Unmarried Couples

It is good advice for cohabitees have a Will in place, as cohabitees do not automatically inherit anything from their partner’s estate upon death and therefore the making of a Will is essential.

Financial Advice relating to unmarried couples

We also advise that cohabitees take financial advice in relation to obtaining suitable life insurance on each other’s life, to provide some measure of financial security in the event of the death of their cohabitee. This is because many pension schemes do not pay out the widows or widowers pension to a cohabitee, in the way they would if the parties had been married. We also advise that insurance may be necessary to pay Inheritance Tax, since the exemption a married spouse has in this regard is not available to a cohabitee.

To minimise the uncertainty regarding the legal ownership of the home, it is important that from the outset of the purchase of the property, cohabitees agree as to how their property is to be owned in the event of a relationship breakdown or death.   • review rating 5  Stuck in a legal rut? call Whiterose Blackmans Solicitors LLP. in 2017 we had new UPVc flush fit windows fitted to our three bedroom detached house. From the day the windows were fitted we had problems and issues. A question I often ask myself, time after time. Is why did I pay the full amount knowing I wasn’t 100% happy. The window company Ryburne Windows of Halifax kept fobbing us off with excuses after excuses. They had our money and we felt powerless to do anything. They didn’t even have a formal complaints procedure. Which they were supposed to have being a CERTASS member. The Director of Ryburne’s told us, “just keep on writing in as the buck stops with me”. After many letters of complaint to the window company and CERTASS - who are a complete waste of time. We decided after two and a half years of complaining we would instruct a Solicitor. We went to see Whiterose Blackmans Solicitors LLP armed with many documents and photos of the poorly fitted and poorly manufactured windows. Whiterose Blackmans Solicitors LLP instantly understood our predicament and agreed to take on our case. Despite all the photographical evidence and a joint independent Royal Institute Chartered Surveyors (RICS) report into the manufacture and installation of the windows. The window company still wouldn’t accept the findings of the Surveyor’s report. They even got a former associate of theirs recommended by CERTASS to do a desk top critic of the independent surveyor's report. They failed on their attempt to introducing it as evidence to the courts. Thanks to a robust defence from Whiterose Blackmans Solicitors LLP.
