Mr B, a taxi driver, was interviewed by the police following allegations made by a passenger that he had sexually assaulted him.
Kamran Hussain was instructed and represented the accused at the police station, where he was formally interviewed under caution by the police.
The allegations were denied, and Mr Hussain provided robust advice to Mr B. This included preparing a written statement, setting out his denial, followed by a ‘no comment’ response to all questions asked by the police in the interview.
Mr B followed this advice, and the prepared statement included facts such as Mr B had worked as a taxi driver for over a year and had picked up many passengers during this time. He could not recall the passenger in question, but he was clear that he had not sexually assaulted any passengers.
Following the interview, the police decided to take ‘no further action’, and the accused was able to return to his employment as a private hire taxi driver.
