Harassment and Injunction Solicitors

What is Harassment? 

The definition of harassment is ‘pursuing a course of conduct which causes a person alarm or distress’. The Protection from Harassment Act 1997 defines harassment. What is considered harassment is usually wide and therefore, what you consider to be harassment may not in fact be. The conduct being complained of must be designed to cause a person alarm or distress. The offender must also have pursued a ‘course of conduct’, which means more than one incident of harassment has taken place.

Are You Being Harassed?

Harassment can occur in all aspects of your life, at home, at work, neighbour harassment, former friends, ex-partners, spouses, colleagues, acquaintances or even by people you don’t know. It is a criminal offence, and civil proceedings can also be brought against the offender. When someone takes the step to contact a Solicitor, they have often reported the harassment to the police first, who have decided not to take any action.

The Police normally advise that a Solicitor is contacted in order to obtain an injunction against the offending party. If an injunction is obtained and then later this is breached, the Police can intervene.

How can a Solicitor help?

We usually commence action by way of a formal notice to the offending party requesting them to cease and desist their conduct. Most times, the offender stops their conduct on receipt of a notice from a Solicitor and no further action is necessary.

In some instances, if the conduct does not stop, then we would assist you in obtaining an urgent injunction order from the Court. This is an order from a Court which compels the offending party to stop the conduct with serious sanctions attached to the order for breaching it. We represent you throughout the whole process until the conclusion of the matter. We have successfully obtained injunction orders for many of our former clients, all of whom were in desperate need of this type of protection and are proud to consider ourselves as specialists in this niche area.

In some cases, it may be appropriate to first send a cease and desist letter demanding that the behaviour stop. A solicitor-issued letter can place the individual on formal notice and may resolve the matter without the need for court proceedings. If the behaviour continues despite this, it may then be necessary to apply to the court for a harassment injunction.
